VCE Systems, including, but not limited to Vblock™, VxBlock™, VxRack™ branded products sold prior to 2018, VxRack Flex, and VxRack SDDC (13G and earlier) systems, generally contain software from VCE, EMC, Cisco, VMware and/or other third party providers—as noted on the VCE Quote issued for the system being purchased. If an end user customer has a written, executed agreement with one of the following companies containing license terms applicable to the specific software product being purchased from VCE as part of a VCE System, such license terms control. In the absence of such an agreement, the following terms control:
- EMC and VCE Software: EMC branded software is provided to an end user subject to the then-current EMC Software License and Maintenance Agreement (the “EMC EULA”), the current version of which is available HERE.
- Cisco Software: Cisco branded software is provided to an end user subject to the then-current Cisco end-user license terms (the “Cisco EULA”), the current version of which is available HERE.
- VMware Software: VMware branded software is provided to an end user subject to the then-current VMware Software License and Maintenance Agreement (the “VMware EULA”) appropriate to the VMware product ordered as specified on a Quote, the current versions of which are available HERE.
- Microsoft SQL Software: Microsoft branded software is provided to an end user subject to the then-current Microsoft end-user license terms (the “Microsoft EULA”), the current versions of which are available HERE.
- HyTrust Software: HyTrust branded software is provided to an end user subject to the then-current HyTrust end-user license terms (the “HyTrust EULA”), the current version of which is available HERE.
- Other Third Party Software: Any other Third-Party Software not listed above is subject to the standard license terms for such third-Party Software provided to the end user.
- Federal Customers: Federally-Approved EULAs for VCE products sold to the US government are available here.
Third Party Software:
License rights for any third party software pass directly from the third-party licensor to the end user and are subject to such third party’s software terms, including as set forth above. By purchasing services from VCE (directly or through one of its authorized channel partners) which include the installation and logical configuration of such third party software, each end user customer authorizes VCE to accept these license terms on its behalf or on behalf of its end users as a condition of installing or using the Software.
